Terms of Service

1. Acceptance of Terms

By accessing or using digithrivesolutions.in or suite.digithrivesolutions.in (FIMP Studio), you agree to be bound by these Terms of Service ("Terms"). If you do not agree, do not use our services. These terms apply to all visitors, registrants, and enrolled members of Digithrive Solutions ("Digithrive", "we", "our").

2. Services Description

Digithrive provides the following services:

  • The 7-Second Rule Webinar: A 60-minute live online masterclass on first impression principles. Held on webinar.gg. Access link sent upon payment confirmation.
  • FIMP (First Impression Mastery Program): A 6-day live coaching intensive covering all 7 touchpoints of first impressions. Cohort dates are announced in the free masterclass. Includes daily session recordings, WhatsApp community access, and FIMP Studio portal access.
  • FIMP Studio (suite.digithrivesolutions.in): The AI-powered member portal providing 6 coaching tools (Bible AI, Wardrobe Advisor, Body Language Analyzer, LinkedIn Optimizer, Email Generator, Video Audit) powered by FIMP Buddy.

3. Eligibility

Our services are available to individuals aged 18 years and above who are Indian residents or residents of countries where these services are not prohibited. By enrolling, you confirm you meet these criteria.

4. Registration & Account Security

  • You are responsible for maintaining the confidentiality of your login credentials for the FIMP Studio portal.
  • You agree to notify us immediately at info@digithrivesolutions.in if you suspect unauthorized access to your account.
  • One account per enrolled member. Account sharing is prohibited and may result in immediate termination without refund.

5. Payment Terms

  • Webinar (Rs99): Non-refundable once the webinar access link has been sent to your registered email. The Rs99 is a processing fee for the live event — it is not a purchase of content or recording. If you cancel before the link is sent, contact us within 12 hours of payment for a full refund.
  • FIMP Beta (Rs4,999): One-time enrollment fee for the beta cohort of the First Impression Mastery Program. Payment plans (2-pay or 3-pay) are available — all installments must be completed before Day 1 of the program begins. If any installment is missed, access may be suspended until payment is received.
  • All payments are processed via Razorpay. Digithrive is not liable for payment gateway downtime, failed transactions, or errors on the payment processor's end.
  • Failed or disputed payments via Razorpay (chargebacks, returned UPI, card declines) will result in immediate suspension of portal access until resolved.

6. Refund Policy

  • Webinar (Rs99): Non-refundable after webinar link is dispatched. Before dispatch, contact us within 12 hours of payment for a refund.
  • FIMP Beta (Rs4,999): Outcome-based guarantee — if you complete all 6 live sessions, implement the techniques as taught, and do not close at least ONE deal you would have otherwise lost (a deal that closed specifically because of the first impression improvement, not other factors), you are eligible for a full refund. To claim: email info@digithrivesolutions.in within 7 days of program completion with evidence of implementation (session attendance records, what you implemented, what happened with the deal). Subject to verification by Digithrive. This guarantee does not apply if sessions were missed without recordings being watched.
  • No refund if: (a) sessions were not attended or recordings not watched; (b) implementation was not attempted; (c) the person was not actively meeting clients during or after the program; (d) refund is claimed more than 7 days after the program ends.
  • Discretionary refunds: In extraordinary circumstances (medical emergency, genuine hardship), Digithrive may, at its sole discretion, offer a partial or full refund outside these terms. This is not an entitlement.

7. Program Access & Delivery

  • Live sessions: Six consecutive days (Session A: 90 minutes, Session B: 45 minutes). Live attendance is expected. Recordings are made available within 24 hours for missed sessions.
  • Access period: FIMP Studio portal access is granted for the enrolled cohort period plus 90 days post-completion. After 90 days, the account may be transitioned to a read-only or free tier at Digithrive's discretion.
  • Session links: Shared via email and WhatsApp before each session. Links are personal to the enrolled member and should not be forwarded.
  • WhatsApp community: A private community is created for the enrolled cohort. Digithrive reserves the right to remove members who violate community guidelines (spam, abuse, solicitation).

8. AI Tools — FIMP Buddy

  • FIMP Buddy is an AI coaching assistant — it provides guidance based on the FIMP curriculum and is not a substitute for professional advice in domains including but not limited to: clinical psychology, legal consultation, medical guidance, financial planning, or career counseling.
  • AI responses are generated based on user input and curated curriculum content. Responses are advisory only. Results vary based on individual context, effort, and external factors.
  • Digithrive is not liable for any decisions, outcomes, or losses arising from reliance on AI-generated advice.
  • You agree not to use FIMP Buddy to generate harmful, illegal, or deceptive content. Misuse may result in account suspension.

9. Intellectual Property

  • All materials, frameworks, content, session recordings, and tools provided by Digithrive (including FIMP Buddy, the 7-touchpoint system, and all program materials) are the exclusive intellectual property of Digithrive Solutions.
  • Enrolled members receive a personal, non-exclusive, non-transferable license to use the materials for their own professional development. This license does not include the right to reproduce, distribute, publicly display, create derivative works from, or sell any materials.
  • Session recordings are for the enrolled member's personal use only. Uploading, sharing, or distributing recordings publicly (on YouTube, social media, or any other platform) is strictly prohibited and constitutes copyright infringement.
  • Content created by you (e.g., LinkedIn posts, emails, personal application notes) using the frameworks taught is your own IP. Digithrive claims no ownership over user-generated content.

10. Confidentiality & Non-Solicitation

  • Session content, fellow cohort member discussions, and any proprietary frameworks shared during the program are confidential. You agree not to share these with non-enrolled third parties.
  • You agree not to solicit, recruit, or engage Digithrive coaches, staff, or representatives as freelancers or employees during your enrollment and for 12 months after program completion.

11. Conduct & Content Standards

When using our services, you agree not to:

  • Post, share, or transmit content that is defamatory, abusive, hateful, or illegal.
  • Impersonate Digithrive, Rajasekar, or any other person.
  • Use the FIMP Studio portal to spam, phish, or distribute malware.
  • Reverse-engineer, hack, or attempt to access other users' data.
  • Use our platform to promote competing coaching services during enrollment.

Violations may result in immediate account termination without refund, and Digithrive reserves the right to take legal action for damages.

12. Warranty & Service Availability

Digithrive provides services "as is" and "as available." We do not guarantee uninterrupted access to the FIMP Studio portal, live sessions, or AI tools. Planned maintenance will be communicated at least 48 hours in advance. Unplanned downtime will be addressed on a best-effort basis. We are not liable for losses arising from service interruptions.

13. Limitation of Liability

To the maximum extent permitted by applicable Indian law: Digithrive's total aggregate liability arising from or related to our services shall not exceed the total amount paid by you for the specific service giving rise to the claim. Under no circumstances shall Digithrive be liable for indirect, incidental, special, punitive, or consequential damages — including but not limited to loss of revenue, loss of business opportunities, loss of clients, or reputational damage — even if we have been advised of the possibility of such damages.

14. Indemnification

You agree to indemnify and hold harmless Digithrive Solutions, its founder, employees, and agents from any claims, damages, or expenses (including legal fees) arising from: (a) your misuse of our services; (b) your violation of these Terms; (c) your violation of any third-party rights; or (d) any content you post or share through our platforms.

15. Governing Law

These Terms are governed by and construed in accordance with the laws of India. Any disputes shall be subject to the exclusive jurisdiction of the courts in Chennai, Tamil Nadu. By using our services, you submit to this jurisdiction unconditionally.

16. Force Majeure

Digithrive is not liable for failure to perform obligations due to events beyond reasonable control — including but not limited to: natural disasters, government actions, internet service failures, pandemics, or instructor illness. In such cases, sessions will be rescheduled or recordings provided as the primary remedy.

17. Termination

Digithrive reserves the right to terminate your access to FIMP Studio, the WhatsApp community, and any enrolled program without refund if you: (a) violate these Terms; (b) engage in conduct we deem harmful to other members, our brand, or our team; (c) attempt to exploit or hack our systems. Termination is at Digithrive's sole discretion.

18. Amendments

We may modify these Terms at any time. Significant changes will be communicated via email to registered users. Continued use of our services after changes are posted constitutes your acceptance of the updated Terms.
